What Lawyers Do

As the country of law suits, United States seems to have the most lawyers. It almost seems too easy to become a lawyer in America since there are too many around and the common perception that people have about what lawyers do is just arguing very well. But actually, earning the right to practice law and the responsibilities they carry are very difficult things to do.

In United States, law is taught at law schools. Law schools in America are graduate schools where a BA degree, most often Bachelor Degree of Laws, is a perquisite for admission. Though most of the law schools are part of a University, few of the law schools are independent institutions. The degree received upon graduation is a J.D. (Juris Doctor) a Ph.D is not available for the study of law because the degree in law does not require the submission of a full dissertation based on original research. There are other post doctorate degrees such as LL.M, the Legum Magister, or the S.J.D., the Scientiae Juridcae Doctor for those who are interested in studying and receiving credentials in a specific area of law. After going through an internship at a firm to earn experience, the lawyer can take his or her own stand.

The lawyers have many responsibilities regarding law. They not only practice oral arguments in courts but they must research, write, counsel and give legal advice to others. The oral argument is practiced in courts where a lawyer represents their client. Often times, the lawyer must brief a court in writing on the issue in the case before it can be orally argued. The argument is based on the law so the lawyer must do research where the lawyer looks for relevant facts and law and prepare for an oral argument accordingly. During the research, the lawyer must maintain a good relationship with the client and through that, the lawyer will discover facts, clarify what the client wants to accomplish and their expectations and start developing claims or defenses.

Aside from what they do in court rooms, the lawyers give legal advice to people where a lawyer gives advice to their clients about what action they must take. The lawyers also protect intellectual properties such as filing patents, trademarks, and industrial designs. The lawyers negotiate and draft contracts between the buyers and sellers as well as settling a case with two parties. In some places, the lawyers carry out the intent of the deceased, where the lawyer help out people to write wills and trusts and the lawyer will ensure the efficient disposition of a person’s property after their death.

The lawyers carry a lot of names. A person learned in the law, an attorney, counsel or solicitor, or a person licensed to practice the law. The lawyer must abide the law but sometimes they must use the law against the rightful to defend their clients. Though it is a lawful practice, it is not a pleasant sight to see. But in …

Start a Nursing Career With CNA Training

In terms of healthcare professionals, Registered Nurses, or RNs, are the largest group. Many RNs began their nursing career as Certified Nursing Assistants, or CNAs, by completing CNA training courses.

While CNA training programs differ according to the state, most CNAs must complete 16 hours of hands-on training, known as “clinicals,” and 75 hours of in-class coursework.

Some institutions offer distance learning CNA classes. However, traditional training is completed at nursing homes, healthcare facilities and junior colleges.

Depending on the place of employment, CNA job requirements will vary. Often, CNAs are called upon to work under RNs and provide bedside care to patients, such as assisting with personal hygiene tasks, changing bedsheets and transporting patients throughout the facility.

There are numerous CNA programs. The majority of programs offer similar coursework and training.

One Available CNA Training Course

CNA training through the Red Cross may be offered at no cost, with the student only paying an approximate $100 state exam fee. This Red Cross program is available in many states. The Red Cross’ coursework falls in line with national standards for CNA curriculum and follows specific state guidelines.

Requirements for Red Cross CNA Training Participation

The Participant must:

– Be at least 18-years-old, – Not have been convicted of a felony for at least seven years prior to participation, – Not have a communicable disease, – Not be pregnant.

A prospective CNA student should talk to their physician about any disabilities or medical conditions they may have that could hinder physical tasks demanded by this vocation, particularly in terms of lifting and moving patients. On January 1, 2012, a law passed that prevents health providers from being forced to perform heavy lifting. Now, all healthcare facilities are required to provide a lifting device or team in order to prevent individual workers, like CNAs, from being injured on the job.

Those who take a Red Cross CNA course are expected to be on time for class and not be absent for six hours or more of total instruction time. Missed hours must be completed at a later date. All tests must have a passing score of at least 80 percent.

Once prospective CNAs finish the Red Cross coursework, they will have to pass an exam consisting of two parts. One part is a skills test where the test taker must successfully complete several hands-on tasks. These skills are those that students learn during clinicals.

The other part of the exam is a written test. Each part of the exam is completed the same day, and test takers have five and one-half hours to finish.

Skills a CNA May Be Asked to Demonstrate During an Exam

These skills include:

– Securing wheelchair locks,

– Gait belt use during transfers,

– Drawing privacy curtains,

– Raising bed rails before leaving a patient,

– Respecting a patient’s privacy and dignity,

– Knocking before entering the patient’s room,

– Covering patients,

– Calling a patient by name,

– Introducing one’s self,

– Giving the patient a …

Importance of the K-12 Education System

K-12 education is an innovative education system. This area of education has a dominance over the conventional educational systems as it puts more weight on thinking and reaching own self-explanatory conclusions.

The way of teaching here is completely different and phenomenal. Teachers generally follow the tactic of asking students to work on a lot of assignments since it develops an intellectual, yet interesting learning habit. In reality, this method helps the students in revising what has been taught previously. In K-12 education system, all the students are given individual attention and hence they understand their subjects in a more practical way. The role of a teacher here is just to guide them in the right way and provide them with learning opportunities. What really happens is that, the individual discovers his own learning capacity and success depends on the thinking ability of the student.

The classroom activities may be similar to what is being practiced in a public school where students go and get their notes and submit records but the key difference is that her in K-12 classes, the students are encouraged to bring about their personal thoughts and visions . Students enroll themselves in different forums and educational clubs where they get to discuss many points for the same topic and get different views. The teachers here contribute so much as to turning every discussion into a positive note cooperating with the students.

K-12 education system has revolutionized the education system in India. Over the years, the level of education system and syllabus has greatly improved in time. The K-12 segment accounts for the lion's share of India's educational market. Students are provided with the ultimate learning opportunities. The school invests thousands of dollars in bringing the best infrastructures. It is also equally important that the student utilizes this system in best possible ways. He must always evaluate the available information to jump to a rational ending. This is the type of educational platform any student can experience in the K-12 program. Therefore, it is no surprise that this methodology is being introduced by most educational institutions in India.

The traditional learning styles have their own merits, but this new and innovative education strategy is superior in that. It helps the students work individually and find solutions on their own. This strategy makes students self-determining, reliable and indulgent. It also improves the relationship between the teacher and students and brings a warm classroom atmosphere. Such a harmonious atmosphere can create masterminds who, in the long run, can become assets not only to the school but to the society as a whole. …

Getting Your Man As a Career Woman

You’re a go-getter at work. You understand exactly what your employer needs and you can deliver. You excel in your professional life because you are a strong, confident woman. But do you apply these same tactics to your romantic life? Lots of men will claim to like a powerful, independent woman but will not react favorably to a woman who treats them like a task to be completed. How do you walk the line between being a confident professional and a woman in search of love? Comprehending the male psyche is not easy, but it will certainly help you figure out what he wants and needs out of a relationship.

Everyone likes a little bit of mystery in a new relationship, especially guys. While common knowledge, this can often be overlooked by a working-minded woman. The professional woman attacks projects with diligence and is rarely unavailable. This takes all the fun out of the chase for a guy! Answering every phone call, arriving promptly, being available whenever he asks – these are all things that, while obviously successful measures at work, will take all the thrill out of a new relationship. In order to catch and keep his interest, you have to emphasize the aforementioned sense of mystery. It creates a more interesting dynamic between a couple that is just getting to know each other. When you don’t answer the phone on the first ring, or at all, it gives him a few moments to wonder what you’re up to. It can be exciting to try to figure out where you are, what you’re doing and when he’ll see you again. Don’t hand it all to him on a silver platter.

In reality, most men desire the same comfort that a woman takes out of a strong relationship. They want someone to communicate with on a deeper level, someone they can trust and feel safe with. The funny thing is, guys don’t look for these qualities when seeking out a new partner. They tend to gravitate towards women who are unreliable and flighty, which is why so many men have been through so many short-term relationships. Guys are instinctively attracted to a woman who needs to be “tamed”, even though these types of women are rarely willing to be tamed!

It’s not that difficult to appeal to these desires and use them to lure him in. There are a few simple ways you can play the part of the unbridled filly without having to sacrifice who you really are (which is who he really wants in the end).

Education: The Foundation Of Everything

As learning is the basis of knowledge, education is the structure from which knowledge flows.

Accumulating information is like having a marble connection, what do you do with it once you have it? The byproducts of education – awareness of varying concepts, appreciation for ideas, understanding divergent philosophies – all are powerful foundations for growth and change.

Intelligence contains within itself the ability to listen and reason, the knowledge to act within reason and the power to create. From education comes wisdom and from that wisdom, solutions are born that propel us forward, whether constructing a building or nurturing an idea.

With Knowledge Comes Responsibility

True knowledge is fearless, made strong by the absence of doubt and fortified by pillars of information. Cultivating it simply requires an open mind and a desire to learn. Channeling knowledge towards meaningful expression is always the challenge.

As William S. Burroughs, American writer and visual artist, once stated, "The aim of education is the knowledge, not of facts, but of values."

Every physical structure, every scientific achievement, every philosophical advancement, all have one thing in common; they were brought into existence by educated opinions based on knowledge. The evolutionary path of civilization would have been dramatically different had experiments and new ideas been based on 'guessing' or 'gut feelings', rather than analytical observation.

Scientific Facts Shape Our Future

A great example of education-based evolution is Darwin's well-known Theory of Evolution . It is one of the most substantiated theories in the history of science. Hard to imagine such a ground-breaking and historical hypothesis being put forth without the benefit of informed analysis from knowledgeable professionals.

During the beginning of his research, Darwin was much more an observer than a geneticist. He could document the pattern of evolution, but did not possess the scientific training to understand and subsequently translate his observations. Without the corroborative knowledge to support his theory, it would have proved difficult to answer the inherent questions of 'how' or 'why' it happened.

Evidence gathered from various scientific disciplines, including paleontology, developmental biology, geology, and genetics, enabled scientists to advance Darwin's stream of 'theoretical consciousness' into mainstream discussion. Questions were raised and explanations were given. It is easy to imagine Darwin's groundbreaking theory never becoming more than coffee-table talk in the absence of fact-based science.

Where Learning Leads … Wisdom Follows

The dictionary defines 'foundation' as the basis or groundwork of anything. Education is defined as the act or process of implying or acquiring general knowledge (in conjuction with) developing the powers of reasoning and judgment. Together, they form the bedrock of learning-based understanding … the path to wisdom.

Wisdom is the grand enabler. With it, all is possible. Without it, nothing is achievable. Wisdom created the pyramids and thrust us into space. It taught us to fly and how to come back down to Earth safely. Wisdom is the evolution of education and architect of our reality.

As a child learns and develops a foundation for life, so too, does learning …

Avatars and Robots As Our Future Teachers?

Not long ago, I was discussing the rapidly approaching reality of augmented school curriculums using Avatars, Online Lectures, and Robots. Sounds like a Science Fiction film, but this reality is coming faster than most people realize. I’d like to present some additional dialogue on this.

You see, an acquaintance asked if I’d heard of the concepts of avatars in teaching, and specifically pointed me to the MindShift educational blog, then he wondered my thoughts on the teacher-student relationship with the future of robots and avatars and if I believed online college lectures were the future. Interestingly enough, I do, and see all of these and more education technologies completely reshaping how we think of school. Let me now explain some of my experiences and observations.

Now then, when I went to the first DARPA Grand Challenge, at the banquet I sat with a lady from Florida who was a psychologist and at the table we all chatted about human-robot interaction, then later as I watched the work at Carnegie Mellon, MIT and in Japan with Asimo on emotional mimicking and mirroring, all of that made sense to me for emotional bonding, I get it. Indeed, I went to an interesting lecture at the University of Riverside in CA where Autistic Teaching researchers showed unbelievable success in the classroom, freeing up teachers from costly one-on-one teaching, which might be “appropriate” but hard to stomach for the taxpayers and school systems.

Then I watched the lectures on kids in Quora (Sp?) where they worked with Avatars and collaborated half way around the world. Yes, I have written on this topic, all those addressed in here in this article and how to use the synergy of it all by merely understanding how the brain thinks, learns, and synthesizes information. Kids really like this stuff, perhaps because it is new, and maybe they will not like it once the nuance wears off in let’s say 15-years when robots are pervasive in all aspects of modern life, however we have a real opportunity right now, and we should take it.

You see, I am unconvinced that merely talking about it and writing about it is enough anymore. I believe it is time to bring it all to fruition and to make it happen, only then can we reap the rewards of having educated the next generation to the point that they can survive, thrive and improve upon our technologically advanced society. That’s how I see it, how about you. Shoot me an email, let’s talk. Until then please consider all this and think on it.…

Education In Today's World

Today's world is undergoing rapid changes and the implication of these changes on education and educationalists is great.

Education today requires one to mold a child into an individual capable of contributing effectively to society and to the world community at large. Children in today's world must be taught to think and not merely to remember. A sense of responsibility has to be developed for knowledge. Without responsibility, learning without wisdom can be a dangerous thing.

The "drive to learn" in children must be aroused. They must enjoy the adventure of planning, feel the thrill of accomplishment and yet be able to cope with the necessary drudgery, which is part of all work.

The art of teaching, like the art of healing consists in discovering the make-up of each child. The teacher has to discover what keeps pupils active. Be able to understand and candidly answer: Why children do not go to school with the same interest and enthusiasm as they go to play? Or, why they want to throw away books on nature and birds and yet run after butterflies in the garden.

A great deal of the teaching / learning process today is done outside the school. Much information about the world and other human beings is learnt by pupil day after day from various sources. But it is the schools, colleges and the universities, which help integrate these bits of information into wholesome education.

Any satisfactory formal education should achieve at least three minimum objectives –

i) Education should provide the student with the fundamental knowledge and basic skills that he or she will require as a working member of the community.

ii) Secondly, there is the social objective. Education should aim at integrating the student with the society in which he will work and establish the ethical and moral standards that will guide his decisions and give him a sense of social responsibility.

iii) Thirdly, there is the cultural objective. Education should help the student as in individual to be more self sufficient, to develop his or her inner resources and to lead a rich and rewarding life. …
